PRE-LAUNCH NOTE: This document is the operating pre-launch text. It will be reviewed by California firearms counsel and revised as needed; the version effective at the time you submit a listing or reserve a listing governs that transaction. This notice does not block launch — the terms below apply now. See spec §6.8.
1. The Platform
2a.com is a classifieds publisher. We do not buy, sell, take possession of, or escrow funds for firearms. We connect California-resident sellers with California-resident buyers. Every transfer must complete at Caps Armory under California Penal Code §27545. We provide no escrow service — money changes hands at the FFL, in person.
2. Eligible items
- Long guns (rifles, shotguns) — California-legal configurations only
- Handguns — used / PPT-eligible; buyers must be 21 or older
- Ammunition — California ammunition vendor transfer required
- Accessories — non-serialized; no body armor; no night-vision or thermal
3. Prohibited items
NFA items, machine guns, short-barreled rifles, short-barreled shotguns, suppressors, destructive devices, 80% lowers, body armor for prohibited persons, and any item or marketing that targets minors (AB 2571 / BPC §22949.80) are strictly prohibited.
4. Seller caps
Sellers are limited to a maximum of 3 active listings at any time, and a maximum of 5 listings per rolling 12 months. Selling as a business requires a Federal Firearms License (FFL); private individuals exceeding these caps will be treated as engaged in the business of selling firearms.
5. Reservation hold (24 hours, no escrow)
When a buyer reserves a listing, the listing is held for that buyer for 24 hours while Caps Armory contacts both parties to schedule the transfer. 2a.com does not hold funds, escrow payments, or guarantee the transaction. The reservation expires automatically if the transfer is not scheduled within the hold window.
6. AI moderation
Every listing is screened by an AI moderation agent for California legality, AB 2571 compliance, fraud signals, and PII leaks. A human reviewer (Caps Armory staff) approves every published listing.
7. Caps Armory partnership disclosure
Caps Armory is a licensed Federal Firearms License holder and is the exclusive transfer partner for listings on this platform. Caps Armory is an independent business and is responsible for the DROS background check, 10-day waiting period enforcement, and PPT transfer fee collection (approximately $35 — the maximum allowed under California Penal Code §28055 for a private-party transfer DROS fee). 2a.com may receive referral compensation from Caps Armory; this does not affect the price paid by buyers or sellers.
8. Indemnification
Sellers represent and warrant that every listing accurately describes the item, that they are the lawful owner of the item, that they are a California resident, and that the item is legal for transfer under California and federal law. Sellers indemnify 2a.com and Caps Armory against any claim arising from misrepresentation of an item, including undisclosed defects, mechanical issues, modifications, or chain-of-custody problems.
9. Arbitration
Any dispute arising from use of this platform shall be resolved by binding arbitration in Placer County, California under the AAA Consumer Arbitration Rules. The arbitrator's decision is final.
